I am planning to visit India soon. I have my AP and an expired F1 visa.
I haven't been to India since I got my H1 approved; so I don't have an H1 visa stamp on my passport at all. My I-797 is approved until 2010.
Can you please advise if I should get my passport stamped with my H1 or should I be ok with my AP?

Senate Majority Leader Harry Reid (D-Nev.) suggested Thursday that lawmakers may need to stay until Christmas to finish their must-pass bills.
His comments underscored that one of Congress�s most stubborn bipartisan traditions � the unattainable adjournment date � may again stand the test of time.
According to the current House calendar, the first session will end Oct. 26, giving lawmakers plenty of time to go back to their districts to talk about the session�s successes or failures, depending on their party.
In reality, Congress rarely adjourns before November, oftentimes staying through December to complete the �people�s work� � appropriations bills � before members head home for the year.
Reid said he hoped that the Senate would not stay until Christmas because of the lingering appropriations battle, but he didn�t rule it out. In July, Reid set the target date at Nov. 16, but was less than confident that the goal would be met even at that point.
Reid added he has spent a lot of time negotiating the appropriations process with House Appropriations Chairman David Obey (D-Wis.) as well as the new chief of the Office of Management and Budget, Jim Nussle.
Reid called the difference between the White House budget request and the pending appropriations bills � $21 billion � �a very small amount.� The White House has threatened to veto any spending bill that exceeds its request.
�It�s not as if we are trying to spend this money� on brand-new programs, he said, noting that the funding would go toward law enforcement programs, healthcare and education.
�I don�t want a headache, I want to try to work this out,� Reid said.
He added, however, that the going might be tough, blaming Bush�s �unusual� way of negotiating. �It�s his way or no way.�
House Majority Leader Steny Hoyer (D-Md.) was slightly more optimistic, explaining that House lawmakers have opted to work the week of Columbus Day rather than taking it off like their Senate colleagues.
�We have work to do, and we�re going to [do] it,� Hoyer said. �We are hopeful to certainly get out � we scheduled October 26th as the date to adjourn.�
He added: �I would be unrealistic if I told you that I thought October 26th was a hard date at best.�
House Republicans blamed the inability to meet the deadline on what they described as a light work schedule of early votes and adjournment.
�I think Democrats are coming to the realization that fewer post offices need naming than they had previously thought. It was a fundamental miscalculation on their part,� quipped Amos Snead, a spokesman for Minority Whip Roy Blunt (R-Mo.).
A House GOP aide added: �This majority couldn�t hit the broad side of a barn with a beach ball from point-blank, no less a target adjournment date when not a single spending bill has arrived on the president�s desk to date.
�Having said that, we�re heading for the biggest omnibus in history, and we�ll see it around the time kids start looking for Santa,� the aide added.
In July 2006, then-Majority Leader John Boehner (R-Ohio) proposed abolishing adjournment dates, citing the fact that they are never met on time and are arbitrary at best.
�It means nothing,� Boehner told reporters at the time. �You all know it means nothing because it really does mean nothing. Anyway, there is no reason to have a target adjournment on the schedule.�

Hi,
I have entered in US with a H1B of company A. I got it transferred to company B in Nov 2008 and got it approved .. i have I797 and I94 valid till Dec 2010.
In May 2009 I have initiated H1b transfer with company C and today I came to know that it is denied. I dont know the reasons yet.
Can any one suggest what are my available options.

Hi All ,
First of all , thanks soooo much for this great site. I have a small question. My PD is July 2002 under EB2 / India. I was stuck with name check. Now that name check does not matter because of new rule > 180 days and my PD becomes current from today - April 1 , how long does USCIS take to make a decision about my case ? Do I need to call them and request a case review or do something to see some movement ? Kindly advice. Or is it just wait ?

Hello fellow IV'ans.....
Based on the volume trend shown in the USCIS website I called them and wanted to know whether my case has been pre-adjudicated or not?
Obviously I got the standard answer from the customer service saying the case is pending, I pressed on the fact that I needed to know (based on their website's information) whether the case is pre-adjudicated or not.
The customer Service rep. then forwarded the call to the National Service Center where an officer picked up the call and said "as of September, 02 2009 the case is in the Pre-Decision Unit and that they will decide on the case, but still at TSC.
I am a little confused :confused: coz haven't heard anything, anywhere, anyone talking about case being in the Pre-Decision stage. Your esteemed thoughts please....

Labor clearance done March 2005; I140 approved 11/11/2007. Filed for I485 08/23/2007.
I am changing my title but staying with the same compnay. I am also changing location. few qs
1. Should I file AC21 due to location change?
2. can i file a new LC for the new job title (Its very very different than what what i did earlier) and carry my PD?

On March 19, 2010, the USCIS announced revised filing instructions and addresses for applicants filing an I-131, the Application for Travel Document.
Beginning March 19, 2010 applicants will have to file their applications at the USCIS Vermont Service Center or at one of the USCIS Lockbox facilities.
If you file the I-131 at the wrong location, the USCIS Service Centers will forward it to the USCIS Lockbox facilities for 30 days, until Monday, April 19, 2010. After April 19, 2010, incorrectly filed applications will be returned to the applicant, with a note to send the application to the correct location.

Got a denial notice for my wife's AOS application (I-485) though dates are no where current for us ...
Got an RFE for both of us last month for immunization records etc which was replied on time ... The civil surgeon administered few shots and exempted her on few as she is nursing our newborn ... Now this week our lawyer received a notice of denial (not NOID) of her AOS application on the basis of the medical ... not sure what screwing USCIS is doing but I am pretty sure on one thing - they are running low on budget and need the MTR fees etc to collect additional fees ...
Does anyone else have same or similar kind of experience recently .... appreciate if you can share your experience ...
